This page explains our terms of use for accessing and using the Agile on the Beach NZ Website. By accessing or using the Website you agree to these Terms of Use.

Each section below opens with a one-line summary. If the summary and detailed wording that follows clash, the detailed wording wins.

If anything here is unclear, email trustees@agileonthebeach.co.nz and we’ll help.

By all means look, learn, and link—please don’t break anything.

You may browse, read, and share public links to our pages. Please don’t misuse the Website (for example: introduce malware, try unauthorised access, scrape at scale, use automated collection without our prior written consent, or do anything unlawful). Unauthorised interference may breach New Zealand law.

Our words and brand are protected. Ask before re-use.

Unless stated otherwise, all text, images, video, and design on the Website are © Agile on the Beach NZ Limited and/or our licensors. “Agile on the Beach NZ”, “AOTBNZ” and our logos are trademarks of AOTBNZ. Speaker materials, photographs, and sponsor logos may be owned by their respective creators.

  • Fair use: You may quote short excerpts with a link back and clear attribution.
  • Anything bigger (copying images, videos, slide decks, logos, downloads, whole pages, or creating derivatives) needs our written permission first: trustees@agileonthebeach.co.nz

We try to be right; but remember things change.

We aim to keep information current, but programme details, prices, dates, and availability may change without notice. Treat the Website as general information—not professional advice. You’re responsible for assessing whether the information meets your specific needs before relying on it.

We endeavour to keep the lights on, but can’t promise 24/7.

We work to keep the Website secure and available, but we cannot guarantee uninterrupted, error-free access, nor can we promise the Website will be compatible with your device, browser, or network. To the extent permitted by NZ law, we’re not liable for loss arising from downtime, errors, or harmful code. This doesn’t limit your non-excludable rights under NZ law.

Their house, their rules.

We link to third-party websites and services (e.g., payment processors, social media, websites of speaker and sponsors, etc.). We don’t control those websites and aren’t responsible for their content, accuracy, or policies. Check their terms and privacy notices before using them.

Be respectful. We may moderate.

Where the Website allows comments or submissions, you’re responsible for what you post. Keep it lawful, respectful, and on topic. We may edit or remove content that breaches these Terms of Use or our Code of Conduct. By posting, you grant us a non-exclusive licence to host and display your contribution on the Website.

We collect the minimum we need, keep it safe, and promise not to sell your data.

Use of your personal information is covered by our Privacy Policy. We use cookies, analytics, and trusted third-party service providers. See the Privacy Policy for what’s collected, how long we keep it, and how to control cookies.

Use the Website at your own risk; though remember that you’re still protected by NZ law.

The Website is provided “as is” for general information. To the extent permitted by law, we exclude implied warranties and limit our liability for your use of the Website to direct losses up to NZD 100 and exclude indirect or consequential loss. Nothing here limits your rights under the Consumer Guarantees Act 1993 or obligations under the Fair Trading Act 1986.

Aotearoa New Zealand law applies. We’ll time-stamp any updates.

These Terms of Use are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction.

We may update these Terms of Use from time to time, with any changes applying from the Last updated date shown at the top of this page. If the changes are material, we’ll also take reasonable steps to let you know (e.g., a notice on the Website).

Questions, permissions, or concerns: trustees@agileonthebeach.co.nz. We aim to respond within 5 business days.

If one bit falls over, the rest stands.

If any single part of these Terms of Use is unenforceable, the rest remains in force (also known as ‘severability‘). If we don’t enforce a term once, that doesn’t mean we’ve waived it.
